DOJ to release IRR on Cybercrime law next month

MANILA, Philippines — The Department of Justice (DOJ) is set to release the implementing rules and regulations (IRR) of the Cybercrime Prevention Act of 2012 as it wraps up its round of consultations.

“Probably before the second half of this year we would already have the IRR done. That’s the estimated time,” DOJ Assistant Secretary Geronimo Sy told InterAksyon.com on the sidelines of a consultation meeting in Makati last Friday.
“I think depending on the number of comments that we get, this consultation, may probably be the last.”

The Supreme Court issued its ruling last February upholding certain provisions of the Cybercrime law, including online libel, while also striking down certain provision as unconstitutional, such as the controversial takedown clause. Last month, the Supreme Court denied all motions for reconsideration against their February ruling on the law.

Section 28 of the law gives 90 days for the IRR to be promulgated from the time the Supreme Court rules with finality.

“Ideally we would have wanted to issue it within 90 days from the final denial of the motion for reconsideration of the Supreme Court and I think we would be able to achieve this objective,” Sy said.

Sy added that they have been “very very assiduous” in putting all the comments from various stakeholders into the draft. But aside from the consultations meetings, Sy said that interested parties may also send email, position papers, or request for a meeting regarding the draft version of the IRR.
